The Republican Network for Unity [RNU] has been notified that Colin Duffy has been granted a judicial review permitting him to confer with his solicitor and prepare a legal defence without being overheard and taped by the crown constabulary and that the application is calendared for this week.
Commenting on the case Danny Mc Brearty, National Chairperson of the Republican Network for Unity said:
“The right to prepare and present a defence to charges of which one may be innocent, should to be a cornerstone of any true justice system and is safeguarded under European Conventions, if not British law, even for Irish Republican suspects. Colin Duffy is being denied the right to make his defences and defence witnesses known to his solicitor, without revealing these details to crown constables for potential misuse or misconduct. The very fact that Colin Duffy must seek judicial intervention to be permitted consultation with his legal representative outside of the ears of the RUC-PSNI, is itself an indictment of British law and those who impose and enforce it in the six counties.”
“Colin Duffy has long been a victim of crown persecution beginning with the murder of Sam Marshall outside Lurgan RUC Barracks in 1990 in an incident which bore all the hallmarks of crown collusion and in which Colin Duffy was a witness and perhaps intended target. He was jailed and framed for murders and freed only through the heroic efforts of civil rights solicitor Rosemary Nelson who proved crown subornation of perjury, intimidation of witnesses, and concealment of exculpatory evidence. Rosemary Nelson was herself murdered in what many believe was another act of crown collusion carried out in retaliation for her legal defence of Colin Duffy and other Republicans”.
“The case is becoming a show-trial, already marked by thirteen days detention without charge, trial by media, dubious forensic evidence of a type rejected in the case of Sean Hoey and now denial of the meaningful right to prepare a defence in consultation with his solicitors. Is this the new dispensation of British justice or the old system of injustice changed only by the crown’s hijacking of Sinn Fein’s endorsement of the re-named constabulary as political cover for victimizing Republicans like Colin Duffy?”
