Martin Fleming, 50, from Larne, is one of two men to be charged with shooting Mr Kerr at his home in the Lyle Hill area.

He will now be released from custody on Monday to provide more information to police.

Mr Kerr, a 60-year-old father-of-four, was killed following a struggle with intruders in April.

Fleming was due to make a full application for High Court bail on Thursday, but the court was told his solicitor has been in correspondence with police.

The accused’s barrister, Joel Lindsay, disclosed that he wanted to provide additional information about a crime which he has so far denied having any involvement in.

Mr Lindsay said: “The application is that police would pick him up at Maghaberry Prison on Monday, take him to Antrim Serious Crime Suite to be interviewed and be left back to Maghaberry after that.”

Kate McKay, for the prosecution, confirmed detectives were in agreement with the plan.

Setting out the conditions sought, she added: “He is released into police custody for the purpose of facilitating his interview request.

“He would be returned to custody at his request or when police determine the interview process is completed.”

Granting the application, Mr Justice McLaughlin banned Fleming from having any visits or making phone calls while voluntarily at the detention suite.
