Friend describes Devlin’s ‘cries of pain’

A friend of murdered schoolboy Thomas Devlin has described how he could hear “cries of pain” as the teenager and another friend were attacked.

Fintan Maguire told the Belfast Crown Court jury that as he ran from the two attackers he glanced back and saw his friend Jonathan McKee being hit on the head with a wooden bat by one man while the other changed from chasing him to chasing Thomas, dragging him down from climbing over the fence into the school.

In the dock denying the murder of 15-year-old Thomas, attempting to murder and cause grievous bodily harm to 22-year-old Mr McKee on August 10 2005 are north Belfast men Nigel James Brown, 26, from the Whitewell Road and Gary Taylor,23, from Mountcollyer Avenue.

Brown has already pleaded guilty to a single count of trying to cause grievous bodily harm to Mr McKee.

When the trial began last Tuesday the jury were told how Thomas, Jonathan and Fintan were walking along the Somerton Road beside St. Patrick’s school in the north of the city when they were attacked by two men walking a small black dog.

The Crown alleged that Brown was armed with a baton while Taylor was allegedly armed with a knife.

On Tuesday, Fintan described how he managed to clamber over a fence into the school grounds where he hid behind a building.

He told prosecution QC Toby Hedworth that although he could not see what was happening, “there was a lot of shouting and sort of cries of pain as well”.

He said when the attack was over, he climbed back over the wall and saw Thomas lying on the ground “breathing very heavily”.

“There was a vacant expression on his face and he only took a breath every four or five seconds,” said Thomas’s friend adding that when they pulled his T-shirt up they saw “two puncture wounds on his back”.

During cross examination from Taylor’s defence QC John Orr, Fintan said that despite attending a number of identity parades, he did not pick anyone out as being at the scene that fateful night.

The trial continues.
