Un tribunale ha stabilito che due membri di una banda musicale hanno deliberatamente infranto le condizioni imposte dalla Commissione Parate, suonando The Sash all’esterno di una chiesa cattolica
Thomas Beresford e Stephen Walker sono stati entrambi condannati per aver scientemente violato il divieto di suonare musica non sacra durante una parata commemorativa per l’Ulster Covenant.
I due sono stati identificati dalle riprese fatte all aloro banda, Holywood True BLues, mentre passavano davanti alla chiesa di San Matteo in Newtownards Road a East Belfast.
Un giudice ha descritto le loro affermazioni di non aver visto i segnali luminosi lampeggianti di avvertimento che avvisavano dell’ingresso nella zona con restrizioni come “inconcepibili e non credibili”.
Entrambi gli uomini riceveranno la condanna settimana prossima.
In base ad una decisione della Commissione Parate, durante il passaggio davanti alla chiesa di San Matteo, il 29 settembre, dovevano essere suonati solamente inni sacri.
Il tamburino Beresford, 21 anni di Holywood, ha detto in aula di non aver avvistato alcun segnale perché suonava con la testa abbassata.
Anche Walker, 28 anni di Holywood, ha negato qualsiasi conoscenza della restrizione.
Quando gli è stato chiesto dall’avvocato difensore Michael Boyd se avesse suonato “The Sash” qualora fosse stato a conoscenza della restrizione, il tamburino ha risposto: “No, sicuramente no. Perché non volevo andare in tribunale per questo”.
Ma un avvocato dell’accusa ha insistito dicendo che non c’era altro che imbarazzo nel fermare qualunque persona una volta a conoscenza della notifica.
Sebbene Boyd sostenesse che le prove non erano riuscite a dimostrare la colpevolezza, la giudice distrettuale Amanda Henderson ha condannato entrambi i musicisti perché non hanno ottemperato alle condizioni imposte dalla Commissione Parate.
Ha respinto la richiesta di annullamento presentata da Beresford a causa del suo stile di suonare il tamburo.
Ha detto: “Questo è chiaramente del tutto errato se confrontato con il filmato che abbiamo di Beresford, molto entusiasta di suonare il tamburo, indicando la folla e guardando diritto davanti a sé.
“Trovo assolutamente inconcepibile e incredibile che questi due uomini sarebbero passati accanto ai segnali, lampeggianti di continuo e che avvisavano l’obbligo di suonare solo inni e brani sacri a partire da quel punto.
“Perciò essi hanno consapevolmente violato la determinazione perché gli era stato comunicato quello che non dovevano fare”.
L’udienza è stata aggiornata per permettere la preparazione dei rapporti.

Bandsmen convicted for playing The Sash
A court has ruled that two flute band members deliberately broke marching conditions imposed by the Parades Commission by playing The Sash outside a Catholic church.
Thomas Beresford and Stephen Walker were both convicted of knowingly flouting a ban on playing non-sacred music during part of an Ulster Covenant centenary procession last year.
The pair were identified in footage of their band, Holywood True Blues, passing St Matthew’s Church on the Newtownards Road in east Belfast.
A judge described claims they had not seen flashing warning signs on the prohibited section as “inconceivable and incredible”.
Both men will be sentenced next week.
Under a Parades Commission determination only hymns were to be played as bands went past St Matthew’s on 29 September.
Bass drummer Beresford, 21, of Strathearn Court, Holywood, Co Down, told Belfast Magistrates’ Court he had not spotted any sign because he played with his head “buried” forward.
Walker, 28, from Church Green in Holywood, also denied any knowledge of the restriction.
Asked by defence barrister Michael Boyd if he would have played The Sash had he been aware, the side drummer replied: “No, definitely not because I wouldn’t want to go to court for it.”
But a prosecution lawyer insisted there was nothing other than embarrassment stopping either man from stepping out of their band once aware of the notification.
Despite Mr Boyd arguing the evidence against them failed to establish their guilt, District Judge Amanda Henderson convicted both men of knowingly failing to comply with the Parades Commission conditions.
She rejected Beresford’s claim to have seen nothing due to his drumming style.
She said: “That is clearly absolutely incorrect from the footage we have of Mr Beresford very enthusiastically playing the bass drum, gesturing to the crowd and looking straight ahead of him.
“I find it absolutely inconceivable and incredible that these two men would have walked past these signs, both flashing continuously and indicating sacred tunes, hymns only from this point.
“Therefore they knowingly breached the determination because they were told what they were not to do.”
Sentencing was adjourned for reports to be prepared.
