Tutte le accuse legate alla protesta per le bandiere contro Willie Frazer sono state cancellate
I procuratori hanno detto in tribunale a Belfast che non vi erano prove sufficienti per le accuse contro Willie Frazer di aver partecipato ad un corteo non notificato e di aver incoraggiato altre persone a fare lo stesso nel corso di un discorso davanti alla City Hall.
Questo sviluppo lascia Frazer a rispondere di una sola accusa di possesso di un Taser.
Willie Frazer sta cercando di scoprire chi è responsabile di aver emesso le accuse contro di lui.
Ha detto: “Ho trascorso due settimane in carcere per questo.
“Chiederò tramite la Camera dei Comuni e la Casa dei Lord di conoscere chi ha preso la decisione a livello politico di accusarmi”.
Willie Frazer era una delle figure più alto profilo finite in tribunale dopo le proteste seguite alla decisione del Belfast City Council di limitare l’esposizione della bandiera dell’Unione dalla City Hall.
Fu accusato di incoraggiare o assistere a reati durante un discorso pubblico, e di aver preso parte a marce illegali.
Ma con il ritiro delle altre accuse, è stato comunicato alla giudice distrettuale Fiona Bagnall che i restanti due reati legati alla protesta del 19 gennaio 2013 decadevano.
L’avvocato del Pubblico Ministero, John O’Neill, ha affermato: “Ci sono stati problemi di comunicazione negli ultimi mesi e la Pubblica Accusa è venuta in possesso di parti di informazioni.
“Siamo ritornati indietro, abbiamo valutato nuovamente il caso e il test probatorio non viene più soddisfatto per quanto riguarda le due accuse”.
Con il decadimento delle accuse legate alle proteste per le bandiera, la giudice Bagnall ha accettato di revocare il divieto di partecipare a qualsiasi manifestazione pubblica per Willie Frazer.
Anche il divieto di trovarsi a meno di 1.500 metri da qualsiasi protesta o corteo è stato rimosso.
L’udienza sulla restante accusa di possesso di un Taser, trovato all’interno della sua abitazione, proseguirà la prossima settimana.
Willie Frazer, parlando all’esterno del tribunale di Belfast, ha affermato che il caso era politico.
“Sono sollevato, ma anche molto arrabbiato” ha aggiunto.
“Per 15 mesi sono stati più o meno come agli arresti domiciliari.
” Per fortuna ho avuto una buona squadra di avvocati, ma qualcuno aveva il compito di allontanare Willie Frazer ed altre persone fuori dalle strade”.

Frazer’s flag protest charges dropped
All flag protest charges against loyalist campaigner Willie Frazer have been dropped.
Prosecutors told Belfast Magistrates’ Court there was insufficient evidence on allegations that he took part in an un-notified public procession and encouraged others to do the same by making a speech at City Hall.
The development leaves Frazer facing a single count of possessing a Taser stun gun.
Following confirmation the 53-year-old, from Markethill, Co Armagh, vowed to find out who was behind charging him in the first place.
He said: “I spent two weeks in custody over this.
“I will be demanding to know through the House of Commons and the House of Lords who made the decision at senior policing level to charge me.”
Mr Frazer was one of the most high-profile figures brought before the courts amid demonstrations over the decision to limit the flying of the Union flag at Belfast City Hall.
He was accused of encouraging or assisting offences by a public address, and taking part in unlawful marches.
But with other charges having already been withdrawn, District Judge Fiona Bagnall was told two remaining counts connected to a protest on 19 January 2013 were being dropped.
Public Prosecution Service lawyer John O’Neill said: “There have been disclosure issues over the last number of months and the prosecution have been coming into possession of bits and pieces of information.
“We have now stood back, reviewed the case and the evidential test is no longer viewed as being met in respect of (the two charges).”
With the flag-related charges being abandoned, Judge Bagnall agreed to lift a ban on Mr Frazer participating in any public demonstration.
A prohibition on going within one mile of any protest or procession was also removed.
A contested hearing on the remaining charge of Mr Frazer having the Taser at his home is due to go ahead next week.
Outside the court he claimed that the case against him had been political.
“I’m relieved but very angry,” he added.
“For 15 months I was more or less under open house arrest.
“Thankfully I had a good legal team, but somebody had an agenda to take Willie Frazer and others off the streets.”
