DUP vuole cambiare la definizione di “vittima”

Il Democratic Unionist Party ha annunciato la volontà di emanare una legge che dovrebbe modificare la definizione di “vittima”

Il partito ha dichiarato che il progetto di legge serve per assicurare che i responsabili delle violenze durante i Troubles non vengano definiti vittime.

Attualmente la definizione legale non distingue tra paramilitari, che sono stati uccisi o feriti, e le altre vittime.

Lo Sinn Fein aveva detto che non dovrebbe esistere alcuna “gerarchia tra le vittime”.

Lanciando una consultazione pubblica sulla proposta di legge, il parlamentare del DUP Jeffrey Donaldson ha dichiarato di avere, come obiettivo, il restringimento della definizione di vittima.

“Riguarda come affrontare il passato, e ciò che non siamo disposti a tollerare è una riscrittura dei Troubles in cui i colpevoli, chiunque essi siano, che hanno compiuto atti di terrorismo siano messi sullo stesso piano delle migliaia di persone uccise e mutilate.

“Voglio vedere il processo andare avanti e un Nordirlanda che si mette alle spalle il passato, ma nel cercare di affontare il passato, è importante comprendere chiaramente che c’erano delle irregolarità e queste vengono riconosciute”.

Le vittime sono definite in base al Victims and Survivors (Northern Ireland) Order 2006:

• Qualcuno che è stato fisicamente o psicologicamente ferito come risultato di un incidente legato al conflitto
• Chiunque fornisca una sostanziale quantità di cura su base regolare ad una persona che è stata fisicamente o psicologicamente ferito come risultato di un incidente legato al conflitto
• Qualcuno che ha subito un lutto come risultato di un incidente legato al conflitto

Anche il nuovo forum delle vittime dovrebbe esaminare la definizione di vittima.

DUP seek victim definition change

The DUP has announced plans for an assembly bill which would change the definition of a victim.

The party said the bill is intended to ensure that the perpetrators of violence during the Troubles are not defined as victims.

Currently the legal definition makes no distinction between paramilitaries, who were killed or injured, and other victims.

Sinn Fein said there should be “no hierarchy of victims.”

Launching a public consultation on the proposed bill DUP assembly member Jeffrey Donaldson said the party was seeking to narrow the scope of the definition of a victim.

“It is about how we deal with the past, and what we are not prepared to countenance is a rewriting of the Troubles where the perpetrators, whoever they are, who carried out acts of terrorism are placed on a par with the thousands of people they killed and maimed.

“I want to see the process moving on and a Northern Ireland that puts the past behind it but in seeking to deal with the past, it is important we clearly understand that there was wrongdoing and that wrongdoing is recognised.”

Victims are defined under the Victims and Survivors (Northern Ireland) Order 2006 as:

• Someone who has been physically or psychologically injured as a result of a conflict-related incident
• Someone who provides a substantial amount of care on a regular basis for a person who has been physically or psychologically injured as a result of a conflict-related incident
• Someone who has been bereaved as a result of a conflict-related incident

The new victims forum is also intending to examine the definition of a victim.
