Un ex soldato verrà formalmente accusato per la morte di John Pat Cunningham avvenuta nel 1974
John Cunningham morì dopo che i membri di una pattuglia dell’esercito aprirono il fuoco a Benburb, il 15 giugno 1974.
Cunningham, cattolico di 27 anni, aveva un’età mentale tra i 6 e i 10 anni. Fu colpito tre volte mentre correva verso i soldati.
Il caso contro Dennis Hutchings, 74 anni di Torpoint in Cornovaglia, andrà avanti secondo quanto riferito al tribunale di Armagh martedì 10 novembre.
Hutchings non ha partecipato all’udienza e il suo avvocato difensore non ha rilasciato commenti.
Il pubblico ministero ha detto al giudice distrettuale Paul Copeland: “Avvieremo un procedimento penale”.
Un’inchiesta preliminare era stata prevista per il 15 dicembre, ma tale data non è più adatta, secondo quanto riferisce il Pubblico Ministero (PPS).
Il procuratore ha aggiunto: “C’è una scadenza e sono consapevole che tale data non può essere rispettata, tuttavia sono stati compiuti notevoli progressi”.
Il caso è stato aggiornato al prossimo mese.
Il giudice Copeland ha detto: “Si acconsente ad un nuovo calendario”.
Hutchings è stato originariamente accusato nel mese di aprile – un’accusa che era soggetta a revisione da parte del PPS.
In un comunicato il Public Prosecution Service ha detto di aver completato l’esame del fascicolo di prove.
Il vide direttore del PPS Michael Agnew ha dichiarato: “Il PPS ha effettuato un attento esame di tutte le prove e le informazioni disponibili in questo caso.
“Abbiamo concluso che vi è un ragionevole prospetto di colpevolezza e che il test per chiedere un procedimento penale è stato passato positivamente”.
Una nuova indagine sulla morte di John Cunningham fu avviata nel 2013 dopo che il direttore del PPS Barra McGrory richiese una revisione delle circostanze in cui avvenne la sparatoria.

Ex-soldier to be prosecuted over Troubles death
A former soldier accused of the attempted murder of John Pat Cunningham in 1974 is to be prosecuted, a judge has heard.
Mr Cunningham died after members of an Army patrol opened fire in Benburb on 15 June 1974.
The 27-year-old Catholic, who had a mental age of between six and 10, was struck three times as he ran from the soldiers.
The case against 74-year-old Dennis Hutchings, from New Road, Cawsand, Torpoint in Cornwall will proceed, Armagh magistrates’ Court heard on Tuesday.
Hutchings did not attend and his defence solicitor made no comment.
A public prosecutor told District Judge Paul Copeland: “It will proceed as a prosecution.”
A preliminary inquiry had been scheduled for 15 December but that date is no longer suitable, according to the Public Prosecution Service (PPS).
The prosecutor added: “There is a target date and I am very mindful of that. That date cannot be met, however significant progress has been made.”
The case is to be mentioned again next month.
Judge Copeland said: “It is by consent that a new timetable be structured. The accused is excused.”
Hutchings was originally charged by detectives in April – a holding charge that was subject to review by the PPS.
In a statement the PPS said it had completed an examination of the file of evidence.
PPS assistant director Michael Agnew said: “The PPS has carried out a careful examination of all of the available evidence and information in this case.
“We have concluded that there is a reasonable prospect of conviction and that the test for prosecution is met.”
A new investigation into Mr Cunningham’s death was launched in 2013 after PPS director Barra McGrory QC requested a fresh review of the circumstances surrounding the shooting.
