I legali di un ex consigliere del Sinn Féin e di un adolescente accusato di aver ucciso l’agente PSNI Stephen Carroll hanno detto che stanno facendo domanda di far cadere le accuse contro di loro
Entrambi negano l’omicidio di Carroll, avvenuto mentre era in servizio a Craigavon, il 9 marzo 2009, e di possedere un fucile d’assalto AK47 con l’intento di mettere in pericolo la vita.
Gli avvocati della difesa che agiscono per conto di McConville e Wootton ha riferito alla Belfast Crown Court che avrebbero fatto domanda per il ritiro delle accuse di omicidio.
McConville deve anche affrontare due accuse di possesso di esplosivi con l’intento di mettere in pericolo la vita ed il loro possesso in circostanze sospette, nel periodo tra l’11 ottobre 2006 e 11 ottobre 2007.
Lui nega le accuse ed il suo avvocato ha detto alla corte che l’accusa è “viziata”.
Wootton è anche accusato del tentativo di raccogliere informazioni che sarebbero state utili ai terroristi, relative al domicilio di un funzionario di polizia in servizio, tra il 10 gennaio 2009 e 10 marzo 2009.
Sua madre, Sharon Wootton – che vive allo stesso indirizzo del figlio – affronta un’accusa di aver cercato di pervertire il corso della giustizia. Infatti è accusato di aver “rimosso uno o più computer da casa, credendo che la sua abitazione sarebbe potuta essere perquisita e tale computer (o più di uno) finire nelle mani della polizia”.
Al giudice è stato detto che le domande giuridiche vengono fatte anche a suo nome.
Il giudice Hart ha chiesto sia agli avvocati della difesa che a quelli dell’accusa di presentare una bozza degli argomenti per chiedere il decadimento delle accuse e lui fisserà delle udienze in data da stabilirsi.
Stephen Carroll, 48 anni sposato e nonno, con 24 anni di servizio nella polizia, fu ucciso da un cecchino in un agguato dopo aver risposto ad una chiamata di emergenza in Lismore Manor, Craigavon. Era quasi alla fine del suo turno di 12 ore.
L’omicidio avvenne appena due giorni dopo un attacco armato contro la caserma Massereene a Antrim, in cui vennero stati uccisi due soldati, mentre ritiravano della pizza.
Carroll è stato il primo poliziotto a essere ucciso da quando la RUC è stata sostituita dalla PSNI.

Carroll murder duo ‘want charges dropped’
Lawyers for a former Sinn Féin councillor and a teenager accused of murdering PSNI Constable Stephen Carroll have said they are applying to have the charges dropped.
The pair both deny murdering PC Carroll while he was on duty in Craigavon, on 9 March 2009, and possessing an AK47 assault rifle with intent to endanger life.
Defence lawyers acting on behalf of McConville and Wootton told Belfast Crown Court they would be applying for a ‘no bill’ on the murder charges.
McConville also faces two charges of possessing explosives with intent to endanger life and possessing them under suspicious circumstances, on dates between 11 October 2006 and 11 October 2007.
He denies the charges and his solicitor told the court the indictment is “flawed”.
Wootton is also charged with attempting to collect information which would be useful to terrorists, relating to the home address of a serving police officer, on dates between 10 January 2009 and 10 March 2009.
His mother, 38-year-old Sharon Wootton – who lives at the same address as her son – faces a charge of perverting the course of justice. She is alleged to have “removed a computer or computers from her home address, believing her home address might be searched and the said computer or computers seized by police”.
The court was told legal applications would be made on her behalf as well.
Mr Justice Hart directed both defence and prosecution lawyers to lodge skeleton arguments for the no bill applications and said he would hear submissions on a date to be fixed.
PC Carroll, a 48-year-old married man and grandfather with 24 years service in the police, was shot dead by a gunman lying in wait as he answered a 999 call-out in Lismore Manor, Craigavon. He had been nearing the end of his 12-hour shift.
The murder came just two days after a gun attack on Massereene Army Barracks in Antrim, in which two soldiers were shot dead while collecting a pizza delivery.
PC Carroll was the first police officer to be murdered since the RUC was replaced by the PSNI.
