Un lealista è stato condanato all’ergastolo per un omicidio settrio compiuto 40 anni fa, con la pena minima fissata a 25 anni
A febbraio 2011 Clarke fu accusato di omicidio e del possesso delle due pistole utilizzate nell’attacco.
In base ai termini dell’Accordo del Venerdì Santo, Clarke dovrebbe essere rilasciato dopo due anni di carcere.
Il caso era stato riaperto dall’Historical Enquiries Team dopo che le nuove tecnologie avevano permesso di identificare Clarke come l’assassino che aveva lasciato le sue impronte sulla porta del bar di Fusco.
Venerdì il giudice McLaughlin, ha impostato la pena minima a 25 anni ma ha detto a Clarke: “Sono pienamente consapevole del fatto che l’affetto della Legge sulle Sentenze in Irlanda del Nord (Northern Ireland Sentences Act) introdotta dal Belfast Agreement, se applicabile nel tuo caso, comporterà che non sconterai nulla del genere”.
Fusco vene ucciso da Clarke all’interno del bar. Il giudice ha ricordato come fosse un uomo completamente innocente che lavorava per sostenere sua moglie e la famiglia, servendo la popolazione senza discriminare e senza offendere nessuno.
Afferma che è stato scelto come obiettivo dell’uccisione in maniera brutale e terribile.
Clarke ha già trascorso 16 anni in carcere per un omicidio commesso due anni dopo l’omicidio di Alfredo Fusco.

Loyalist Clarke sentenced to 25 years for Fusco murder
A loyalist given a life sentence for a sectarian murder nearly 40 years ago, has been set a minimum tariff of 25 years.
In February 2011 Clarke was convicted of murder and of possessing the two guns used in the attack.
Under the terms of the Good Friday Agreement, Clarke is likely to be released after two years in custody.
The case was reopened by the Historical Enquiries Team after new fingerprint technology allowed them to identify Clarke as the gunman who left his prints on Mr Fusco’s cafe door.
On Friday, the judge, Mr Justice McLaughlin, set the minimum tariff at 25 years but told Clarke: “I am fully conscious of the fact that the effect of the Northern Ireland Sentences Act which was introduced as part of the Belfast agreement, if applicable in your case, will result in you serving nothing like that”.
Mr Fusco was shot dead by Clarke at his cafe. The judge said he was a completely innocent man working to support his wife and family, serving the public without discrimination and giving offence to no one.
He said he had been singled out for assassination in a brutal and terrifying manner.
Clarke has already served 16 years in jail for a murder committed two years after Mr Fusco was killed.
