La polizia ha avviato un’indagine per omicidio riguardante la morte di un uomo colpito a morte dai soldati nella Contea di Tyrone oltre 40 anni fa
John Pat Cunningham morì dopo che la pattuglia di soldati aprì il fuoco contro di lui il 15 giugno 1974, nella cittadina di Benburb.
Il ventisettenne cattolico, con la capacità intellettiva di un bambino fra 6 e 10 anni, fu colpito tre volte mentre fuggiva dai soldati.
Martedì gli investigatori del Legacy Investigation Branch della PSNI hanno detto di aver riaperto il caso e avviato l’indagine per omicidio dopo “un accertamento delle prove disponibili”.
Hanno chiesto ad eventuali testimoni dell’accaduto di farsi avanti.
Tuttavia la famiglia di John Cunningham ritiene che la PSNI non dovrebbe indagare sul caso.
Hanno sollevato preoccupazioni perché la mossa porterà ad una nuova indagine indipendente eseguita dall’Historical Investigation Unit voluta dall’Accordo di Stormont House.
“La famiglia Cunningham non è stata informata di questo appello odierno” si legge in un comunicato rilasciato dal Pat Finucane Centre.
“Sono stati avvisati attraverso i mezzi di comunicazione.
“Non abbiamo fiducia nel Legacy Investigation Branch della PSNI, che ha lanciato questo appello pubblico”.
L’Ispettore Neil McGuinness, che sta guidando l’indagine per omicidio, ha detto che la polizia ha già fatto alcune analisi sulle circostanze di quanto avvenne quarant’anni fa.
“Adesso abbiamo raggiunto un ponto in cui è appropriato e necessario chiedere assistenza non solo alla popolazione di Benburb ma anche da chi si è trasferito dalla zona, magari in altre parti del mondo, se vogliamo far progredire l’indagine”, ha aggiunto.
“Per prima cosa, voglio parlare con le persone che conoscevano John Pat, per sapere che giovane fosse, i suoi interessi, il suo stile di vita, le sue preoccupazioni.
“Secondo, voglio parlare con chiunque sia a conoscenza di qualsiasi precedente incontro o incidente che ha visto coinvolto John Pat e i soldati. Non importa sapere chi o quanti fossero – mi serve solo sapere se ciò è avvenuto.
“Infine, vorrei parlare con chiunque abbia visto gli spari fatali a Carrickaness, Benburb, alle 11:50 di sabato 15 giugno 1974. Gradirei parlare anche con chi ha informazioni sull’accaduto o con chi ha avuto a che fare con i soldati in quella giornata.
“È mia intenzione impiegare gli investigatori nella zona di Benburb per parlare con i residenti e incoraggio tutti a parlare con gli ufficiali”.

Murder investigation into 1974 Army shooting
Police have launched a murder investigation into the death of a man who was shot by soldiers in Co Tyrone more than 40 years ago.
John Pat Cunningham died after members of an Army patrol opened fire in Benburb on 15 June 1974.
The 27-year-old Catholic, who had a mental age of between six and 10, was struck three times as he ran from the soldiers.
On Tuesday, detectives from the PSNI’s Legacy Investigation Branch said they have reopened the case and a murder investigation has been started, following “an assessment of the available evidence”.
They appealed for witnesses to come forward.
However the family of John Cunningham have said they do not believe the PSNI should be investigating the case.
They have raised concerns that the move will rule out a new, independent inquiry under the Historical Investigations Unit proposed in the Stormont House Agreement.
“The Cunningham family were not informed this appeal was being made today,” a statement from the Pat Finucane Centre said.
“They first heard about it through the media.
“We have no confidence in the PSNI’s ‘Legacy Investigations Branch’ which has launched this public appeal.”
Detective Inspector Neil McGuinness, who is leading the murder investigation, said police have already made a number of enquiries into the circumstances surrounding what happened.
“We have now reached a point where it is appropriate and necessary to ask for assistance from not only the local community in Benburb, but also from people who may have moved away from the area or are in other parts of the world, if the investigation is to be fully progressed,” he added.
“Firstly, I would like to speak to people who knew John Pat, what sort of a young man he was, his interests, his lifestyle, his concerns.
“Secondly, I want to speak to anyone who has knowledge of any previous encounters or incidents involving John Pat and soldiers. It doesn’t matter what these were or what they amounted to – I just need to know about them.
“Finally, I would like to speak to anyone who was a witness to the fatal shooting itself at Carrickaness, Benburb at 11.50am on Saturday 15 June 1974, who has information about the incident or who engaged with soldiers at the time.
“It is my intention to deploy detectives to the Benburb area to engage with the community and I would encourage anyone who has information to discuss it with my officers.
