Un medico è stato incaricato dalle Nazioni Unite di valutare attentamente le condizioni di Marian Price, mentre montano le preoccupazioni per la sua salute
Il medico ONU la visiterà presso la prigione di Hidebank Wood a South Belfast, nelle vesti di relatore speciale delle Nazioni Unite.
La repubblicana di West Belfast è stata tenuta in isolamento per più di un anno dopo essere stata sommariamente incarcerata su ordine del ministro britannico Owen Paterson. La sua condizione è peggiorata al punto che non è stata in grado di partecipare alle udienze, neppure tramite collegamento video.
Peter Corrigan, avvocati dello studio legale Kevin Winters, che rappresenta Marian Price, ha accolto con favore il coinvolgimento delle Nazioni Unite.
“C’è unanime parere medico che Marian Price non sia in grado di partecipare ad eventuali procedimenti giudiziari a causa del deterioramento della sua salute, quindi accogliamo con favore questo intervento da parte delle Nazioni Unite per conto del nostro cliente”, ha affermato.
Le preoccupazioni per la sua salute sono aumentate questa settimana dopo la sospensione del governatore della prigione in cui è internata Marian Price, Hidebank Wood, a causa del suicidio di un’altra prigioniera avvenuto lo scorso anno.
Frances McKeown, sposata e madre di due figli, era una delle due detenute non politiche morte per suicidio in carcere nello stesso giorno del 2011, il 4 maggio. Il governatore di Hydebank, Gary Alcock, è stato sospeso dal suo incarico, secondo quanto riferito dal Prison Service.
I suoi sostenitori dicono che Marian resta in una situazione di elevata vulnerabilità nella prigione di Hydebank, e si teme che la sua vita possa essere messa in pericolo dalle condizioni della sua detenzione.
Pat Ramsey dell’SDLP ha detto: “Devo dire nei termini più forti possibili che questa donna dovrebbe essere trasferita in un ambiente ospedaliero, dove può ricevere le cure mediche ed i trattamenti di cui ha tanto bisogno”, spiega il parlamentare nazionalista.
“È incredibile che questo non sia accaduto fino ad oggi.
“Lo Stato sta gestendo molto male il caso di Marian Price.
“Pur apprezzando la valutazione di un ulteriore medico indipendente, non mi sembra sia veramente necessario.
“Ci sono già abbastanza esami medici che sono tutti d’accordo sul rapido deterioramento della sua salute mentale”.
La prominente repubblicana di West Belfast viene internata da oltre un anno, in continuo isolamento, dopo il ritiro della licenza di rilascio deciso dal Segretario di Stato Owen Paterson.
La grazia reale ricevuta nel 1980, che avrebbe assicurato il suo rilascio, è stata “persa”, secondo quando riferito dal governo britannico. Quell’indulto venne concesso a Marian Price per motivi di salute dopo la brutale repressione da parte delle guardie carcerarie in Inghilterra, che sottoposero lei e la sorella Dolours a oltre 400 sedute di alimentazione forzata durante il loro sciopero della fame.
Il portavoce sulla giustizia dell’SDLP, Alban Maginness, ha accusato la Gran Bretagna di aver semplicemente internato l’attivista politica senza alcun processo.
Per il politico nazionalista a Marian Price non è stato assicurato un adeguato processo legale.
“Noi non appoggiamo l’incarcerazione delle persone a causa di notizie di intelligence o a causa di differenti punti di vista politici. Siamo convinti che lei è stata arrestata dal Segretario di Stato per questo motivo”, ha affermato.
“Lei non ha nemmeno il suo legale a rappresentarla in relazione al rapporto di intelligence.
“Loro (gli inglesi) hanno nominato un avvocato, un avvocato esterno, per rappresentare Marian Price in questa fase – ma il suo avvocato difensore non può nemmeno leggere il rapporto dell’intelligence. Come sarebbe giusto in un processo”.

L’anno scorso, poco prima il suo ordine di internamento, la Price fu accusata di aver sorretto un foglio di carta da cui un uomo in divisa mimetica leggeva un comunicato della Real IRA, durante la commemorazione di Pasqua a Creggan, Derry. Il caso è stato respinto la scorsa settimana dopo che il giudice ha detto che era trascorso un intero anno senza la presentazione, da parte dell’accusa, di alcuna prova.
Ma Marian Price e gli altri tre co-imputati che hanno visto il decadimento delle accuse seguite alla commemorazione di Pasqua, potrebbero vedere la riproposizione delle stesse accuse.
Il Procuratore Capo delal Corona, Barra McGrory, ha detto che la sentenza “non è affatto la fine della questione” e il caso dovrebbe “ricominciare nuovamente in un altro modo”.
Secondo l’avvocato Peter Corrigan qualsiasi mossa da parte della Corona per accusare nuovamente Marian Price rappresenterebbe “un abuso del processo”.
Un’accusa separata contro Marian Price, avanzata la scorsa estate in relazione all’uso di un telefono cellulare “per fini terroristici”, rimane fonte di una potenziale azione penale da parte di McGrory. Nessuna domanda di libertà provvisoria è stata fatta per quella accusa a causa dell’ordine di internamento in corso.

UN doctor to visit Marian Price
A doctor appointed by the United Nations is to assess the condition of internee Marian Price as concerns grow for her health.
The UN doctor will visit her at Hydebank Wood jail in south Belfast in his role as UN special rapporteur.
The west Belfast republican has been held in isolation for more than a year after she was summarily jailed by order of the British Direct Ruler Owen Paterson. Her condition has deteriorated to the point that she has been unable to participate in court hearings, even by video link.
Peter Corrigan of Kevin Winters solicitors, who represents Price, has welcomed UN involvement.
“There is unanimous medical opinion that Marian Price is unable to participate in any legal proceedings due to her deteriorating health so we would welcome this intervention by the UN on behalf of our client,” he said.
Concerns about her welfare were heightened this week after the governor of the prison where Ms Price is being held, Hydebank Wood Prison, was suspended following the suicide of another female prisoner last year.
Frances McKeown, a married mother-of-two, was one of two (non-political) prisoners who died by suicide at the jail on the same day last year — May 4. Hydebank governor Gary Alcock has been suspended from his post, the Prisons Service said.
Her supporters say Marian remains in a vulnerable situation at Hydebank, and there are fears that her life may be in danger due to the conditions of her detention.
Pat Ramsey of the SDLP said: “I have to say in the strongest possible terms that this woman should be moved to a hospital environment where she can receive the medication and treatment she so badly needs,” he said.
“It beggars belief why that has not happened to date.
“The state is failing badly in the case of Marian Price.
“While I welcome a further independent doctor’s assessment it isn’t really required.
“There have already been enough medical examinations carried out that are all in agreement about her rapidly deteriorating mental health.”
The west Belfast republican has been held for more than a year after a release licence was revoked by Paterson.
A pardon she received in 1980, which would ensure her release, has been “lost” according to the British government. That pardon was issued to Marian on health grounds after prison warders in England brutally suppressed her and her sister’s seven-month hunger strike through force-feeding.
SDLP justice spokesman Alban Maginness has accused Britain of simply interning the political activist without trial.
He said Price has not been allowed due process in law.
“We do not support putting people away in prison because of intelligence or because of some political point of view and we are convinced that she has been detained without trial because of that by the secretary of state,” he said.
“She doesn’t even have her own counsel to represent her in relation to the intelligence report.
“They appoint a counsel, an outside barrister, to represent her on that – her own defence counsel can’t even look at the intelligence report. How is that due process.”
MCGRORY DEFIANT
Last year, just before her internment order, Ms Price was accused of holding a piece of paper while a man in camouflage uniform read out a ‘Real IRA’ statement in Derry. The case was dismissed last week after the judge said a full year has passed without any evidence being presented.
But Ms Price and three others who also saw charges arising from the Easter commemoration thrown out of court could see those charges resurrected.
Chief Crown prosecutor Barra McGrory said that the ruling was “by no means the end of the matter” and said the case would be “recommenced in another way”.
Peter Corrigan of Kevin Winters law firm said any move by the Crown to charge Ms Price again in the case would represent “an abuse of process”.
A separate charge against Ms Price, brought last summer in relation to the use of a mobile phone “for terrorist purposes”, also remains a potential source of prosecution by McGrory. No application for bail was made on that charge due to the ongoing internment order.
