Come ho già scritto nella mia dichiarazione scritta del 16 dicembre 2010 alla House of Commons, l’inchiesta Nelson intende completare la sua relazione entro la fine di aprile 2011. Sono responsabile della pubblicazione del rapporto dell’indagine una volta che mi viene consegnata. Sono stato avvisato che ho un dovere, come autorità pubblica in base alla Human Rights Act (Legge sui Diritti Umani), di agire in un modo compatibile con la Convenzione europea dei diritti dell’uomo. Per adempiere a questo dovere, ho bisogno di adottare misure per assicurarmi che la pubblicazione della relazione non violi l’articolo 2 della Convenzione mettendo a rischio la vita o la sicurezza delle persone. Sono stato informato che tali obblighi devono essere rispettati da me personalmente, nella mia veste di Segretario di Stato per l’Irlanda del Nord. Anche se l’Inquiry (l’organismo che compie l’indagine, Ndt) è anche un ente pubblico, in base al Human Rights Act, non ho il diritto di farmi valere su tale organismo per soddisfare i miei obblighi relativo all’Articolo 2 e ho il dovere di valutarle per conto mio. Ho anche il dovere di assicurarmi che la pubblicazione non metterà a rischio la sicurezza nazionale, ad esempio rivelando dati delle fonti di informazioni protette.
Voglio rendere pubblica la relazione nella sua interezza. In caso di eventuali preoccupazioni circa la sicurezza di ogni individuo, la mia prima azione potrebbe essere quella di valutare se queste possono essere affrontate attraverso strumenti alternativi. Se dovessi arrivare alla conclusione, su consiglio, che una modifica del testo possa essere necessaria, vorrei consultare Sir Michael Morland. Nel caso molto improbabile che qualsiasi modifica venga ritenuta necessaria, la mia intenzione sarebbe quella di rendere questo chiaro sulla copertina della relazione.
La relazione deve essere pubblicato prima per la House of Commons, e ho intenzione di pubblicarla il più presto possibile una volta che il processo di verifica è stato completato. Tuttavia, riconosco l’importanza dei rislutati di questa indagine nella vita di alcuni individui. Come con la pubblicazione dei rapporti sulla BLoody Sunday e su Billy Wright, ho intenzione di decidere di mostrare questa relazione in anticipo a coloro che sono stati designati come Parti In Causa dall’inchiesta. Ho intenzione di parlarne con lo Speakr di questa Casa il più presto possibile.
Written Ministerial Statement: The Report of the Rosemary Nelson Inquiry
As I informed the House in my Written Statement of 16 December 2010, the Nelson Inquiry intends to complete its report by the end of April 2011. I am responsible for publication of the Inquiry’s report, once it is delivered to me. I am advised that I have a duty, as a public authority under the Human Rights Act, to act in a way that is compatible with the European Convention on Human Rights (ECHR). To fulfil this duty, I need to take steps to satisfy myself that publication of the report will not breach Article 2 of the Convention by putting the lives or safety of individuals at risk. I am advised that these obligations must be met by me personally, in my capacity as Secretary of State for Northern Ireland. Although the Inquiry is also a public authority under the Human Rights Act, I am not entitled to rely on the Inquiry to satisfy my Article 2 obligations and I have a duty to assess this myself. I also have a duty to satisfy myself that publication will not put national security at risk, for example by disclosing details of sources of protected information.
I want to publish the report in its entirety. Should any concerns about the safety of any individual arise, my first course of action would be to consider whether these can be addressed through alternative means. Were I to reach the conclusion, on advice, that a redaction to the text might be necessary, I would consult Sir Michael Morland. In the very unlikely event that any redaction was deemed necessary, my intention would be to make this clear on the face of the report.
The report must be published first for this House, and I intend to publish the report as soon as possible once the report and the checking process has been completed. However, I acknowledge the importance of this Inquiry’s findings in the lives of a number of individuals. As with the publication of the Bloody Sunday and Billy Wright Inquiry reports, I intend to consider giving advance sight to those who were designated as Represented Parties by the Inquiry. I intend to discuss this with the Speaker of the House in due course.
