anche se apprezziamo i vostri sforzi per porre fine al conflitto esistente nella prigione di Maghaberry sentiamo la necessità di chiarire una questione da lei sollevata il 25 novembre 2014 durante un dibattito a Stormont.
Una campagna volta a erodere i nostri diritti e riportarci ad un grave conflitto viene guidata dal DUP. Da tempo il SET è stato incorporato in questa campagna. È stato affermato da voi, e da altri, che i Prigionieri Politici Repubblicani hanno minacciato il personale del SET. Questa disinformazione, ribadita da lei durante il dibattito a Stormont del 25 novembre, è destinata a minare l’accordo del 2010 e a dissuadere chi ha il potere ci affrontare gli sforzi magligni ed i sotterfugi del DUP.
La nostra dichiarazione “Assistenza Sanitaria scadente” era stata deliberatamente pubblicata in concomitanza con il rilascio del rapporto CJINI sulle cure sanitarie in prigione e per focalizzare l’attenzione sulle gravi carenze all’interno del sistema, che a sua volta può portare alla morte o a gravi lesioni quando si è in custodia: Niall Leonard, Darren Sweeney e Sean Lynch, sono solo alcuni che sono stati gravemente colpiti da tali carenze. Inoltre, pochi giorni dopo il rilascio della nostra dichiarazione c’è stata l’inspiegabile morte di un altro prigioniero, Liam Mulhern, le cui denunce sono ben documentate e che ora sono al vaglio del Prisoner Ombudsman.
La parte della nostra dichiarazione in cui si faceva riferimento all’aperta relazione tra alcuni membri del SET e la famigerata squadra anti sommossa durante le perquisizioni corporali forzate è ben documentata, tramite le denunce interne, di cui il Prisoner Ombudsman è ben consapevole.
Lei deve sapere che un rappresentante dei prigionieri repubblicani ha approcciato il personale sanitario l’indomani della pubblicazione dei titoli sensazionalistici del Belfast Telegraph e ha spiegato le nostre posizioni, come facciamo adesso con lei. Ha anche dichiarato che non c’era alcuna minaccia nei confronti del personale sanitario e che i prigionieri repubblicani erano molto riconoscenti per i faticosi compiti in cui sono impegnati e per la diligenza mostrata, ma che gli incidenti con alcune persone che scherzano con i membri della squadra anti sommossa subito dopo aver denudato a forza un prigioniero repubblicano sono una grande preoccupazione per noi. IL nostro rappresentante ha anche spiegato di aver richiesto, dopo essere stato “spinto” da voi, dallo Sinn Féin e dall’Assessment Team, un incontro con un rappresentante del SET, tre volte verbalmente e due per iscritto ma non ha avuto alcuna risposta. Tali richieste sono state fatte alla fine di luglio e a inizio agosto 2014. I due membri del personale sanitario hanno accettato pienamente le nostra posizione e hanno ringraziato il rappresentante dei prigionieri repubblicani.
L’assistenza sanitaria prestata nel carcere di Maghaberry è, nel suo complesso, scadente. Quest’anno la madre di Niall Leonard, morto suicida in prigione, ha dichiarato che le cure inadeguate ricevute da suo figlio lo avevano portato direttamente alla morte. Un giovane di Derry che si era auto-mutilato, è stato rimandato in cella dove si è ferito gravemente agli occhi. Nel maggio 2013 un’inchiesta sulla morte di James McDonnell – trovato morto in cella pochi minuti dopo essere stato quasi soffocato dai membri della squadra anti sommossa – ha stabilito che l’amministrazione di Maghaberry era venuta meno al suo dovere di prendersi cura dei prigionieri. Solo settimana scorsa è stato riferito che i procedimenti penali sono in attesa di prosecuzione.
Il fallimento del SET nel fornire un’adeguata assistenza sanitaria è diventata un fattore aggravante della nostra campagna per garantire l’attuazione dell’accordo di agosto. L’ambiente creato dal conflitto ha provocato lo sviluppo di una relazione tra il personale del SET e del NIPS (Northern Ireland Prison Service), che chiaramente compromette il dovere del SET di fornire cure ai prigionieri e di rimanere imparziale.
I prigionieri che soffrono di malattie gravi e che richiedono trattamenti medici specialistici non solo non le ottengono, ma le loro vite sono messe in inutile pericolo. Questa relazione ha portato a situazioni oscene dove la giovialità regna tra gli “infermieri” e la squadra anti sommossa, in cui i commenti sprezzanti sono proseguiti incontrollati.
Quando abbiamo parlato male di questa relazione siamo stati messi alla gogna. Siamo stati condannati quando abbiamo ricordato al SET il suo dovere di curare i prigionieri. POchi giorni dopo, Liam Mulhern di West Belfast è stato trovato morto nella prigione di Maghaberry. Ci sono state poche dichiarazioni a suo sostegno o contro il sistema sanitario che ha chiaramente fallito i suoi compiti.
Nonostante la nostra giustificabile opposizione a come opera il SER nella prigione di Maghaberry non siamo mai andati contro il personale. I prigionieri repubblicani incontrano il personale del SET ogni giorno e ogni volta ci comportiamo con disciplina, rispetto e integrità. Non ci sono mai state minacce, velate o palesi, contro il SET o il suo personale da parte dei prigionieri repubblicani o dei nostri rappresentanti.
Crediamo che questo fornisca un’ulteriore prova di come ci sforziamo per assicurare i nostri diritti fondamentali minati dalle finzioni del DUP, che vengono poi trattate come fatti reali. Ci si aspetterebbe che un uomo con la vostra integrità non cadesse nella trappola delle mezze verità e della propaganda portata avanti da chi brandisce un’ascia politica per infrangere tutto.
Saremo lieti se ci vorrà rispondere; dopo che considererà tutti i fatti riguardanti questo problema, speriamo in una più chiara comprensione del perché abbiamo criticato pubblicamente il SET.

Although we appreciate your efforts to end conflict in Maghaberry gaol we feel we must clarify an issue you raised in a Stormont debate held on November 25th 2014.
A campaign to erode our rights and return us to serious conflict is being fronted by the DUP. For some time the SET has been incorporated into this campaign. It has been alleged by you, and others, that Republican Political Prisoners threatened SET staff. This disinformation, regurgitated by you during a Stormont debate (25-11-14), is designed to undermine the 2010 Agreement and Stocktake, and dissuade those of influence from confronting the DUP’s malign efforts and subterfuge.
Our SUBSTANDARD HEALTHCARE statement was deliberately released to coincide with the release of the CJINI report into prison healthcare and, to bring focus on, serious failings within the system which in turn allow for potential death and serious injury in custody; Niall Leonard, Darren Sweeney and Sean Lynch, are but a few who were grievously affected by such failings. Also, within days of the release of our statement we had the unexplained death of yet another prisoner, Liam Mulhern, whose complaints are well documented, and are currently being investigated by the Prisoner Ombudsman.
The section in our statement referencing the overtly cosy relationship between some SET staff and the notorious RIOT SQUAD during forced strip-searches of Republican prisoners is also well documented, through internal complaints, of which the Prisoner Ombudsman is well aware.
You should be aware that a Republican Prisoner Representative approached healthcare staff the day after the sensationalist headlines in the Belfast Telegraph and fully explained the position of ourselves as outlined to you now. He further stated that there was absolutely no threat to healthcare staff and that Republican prisoners were greatly appreciative of the strenuous tasks they undertake and the diligence shown by them, but that incidents with particular individuals joking with Riot Squad members who have just forcibly stripped naked a Republican prisoner is of great concern to us. He also explained that he had requested, after “prompting” by yourself, Sinn Fein and the Assessment Team, a meeting with a SET representative, three times verbally and twice in writing and has had no response, or simple acknowledgement from them. Those requests were made in late July and early August 2014. The two healthcare staff present accepted fully our position and thanked the RPP representative.
The healthcare provided in Maghaberry gaol as a whole is sub-standard. This year the mother of suicide victim Niall Leonard stated that the inadequate care that her son received had led directly to his death. A young man from Derry who had self-mutilated was returned to a cell where he gauged his own eyes out. In May 2013 an inquest into the death of James McDonnell (found dead in a cell minutes after being choked by Riot Squad members) found that the Maghaberry administration had failed in its duty of care to prisoners. Only last week it was reported that criminal proceedings are now pending as a consequence.
The SET’s failure to provide adequate healthcare has become an aggravating factor in our campaign to secure the implementation of the August Agreement. The environment created by conflict has caused a relationship to develop between SET and NIPS staff that clearly compromises the SET’s duty of care to prisoners and their ability to remain impartial.
Prisoners suffering serious illnesses and requiring specialist medical treatments are not only being failed but their lives are being placed in unnecessary danger. This relationship has led to obscene circumstances where jovialness has reigned between “nurses” and Riot Squad members and intimate derogatory remarks go unchecked.
When we spoke out against this relationship we were pilloried. In reminding the SET of their duty of care to prisoners we were condemned. A few days later, Liam Mulhern from West Belfast was found dead in Maghaberry gaol. There were few statements made in his defence or against the healthcare system that had clearly failed once again in its duty of care.
Despite our justifiable opposition to how the SET is operating in Maghaberry prison we have never impeded SET staff. Republican prisoners encounter SET staff daily and at all times we conduct ourselves with discipline, respect and integrity. There has never been any threat, veiled or otherwise, levelled against the SET or its staff by Republican prisoners or our welfare representatives.
We believe this issue provides further evidence of how any effort from us at securing fundamental rights are being undermined by DUP fictions, which are then carried as fact. We would expect that a man of integrity, such as you, would not fall into the trap of peddling myths, half truths and propaganda for those who clearly have a political axe to grind.
We look forward to your response; after you consider all of the facts surrounding this issue, and hope a clearer understanding of why we criticised the SET publically emerges.
