CCTV footage ‘crucial in schoolboy murder case’

Police reconstructions have been used in the case against two men accused of murdering north Belfast schoolboy Thomas Devlin, Belfast Magistrates Court has heard.

Prosecutors alleged the timings, based on CCTV footage of the suspects, fitted closely with when the 15-year-old was stabbed to death near his home in August 2005.

During a preliminary enquiry hearing it was claimed there was enough evidence for Gary Taylor (22) and Nigel Brown (25) to be sent for trial.

Taylor, of Ross House, Mount Vernon, and Brown, formerly of Whitewell Road — both in Belfast — are both charged with the killing.

Crown counsel Kate McKay argued there was enough evidence for a prima facie case against them.

She said CCTV footage had provided “crucial” timings.

But Taylor’s barrister, Mark Farrell insisted: “We do not accept there’s a prima facie case against the accused.”

And a lawyer for Brown countered Mr Perry’s view by pointing out that a senior Crown counsel in Northern Ireland felt the evidence was insufficient.

District Judge George Conner said he would rule on the case early next month after reading the relevant papers.
